What is the purpose of the California Court of Appeals? ›

Their primary function is to ensure that the law is interpreted and applied correctly. The California Courts of Appeal review the vast majority of appealable orders or judgments from superior courts.

Qualifications. To serve as a justice, a candidate must have practiced law for at least 10 years in California or served as a judge in California for at least 10 years.

In law, a majority opinion is a judicial opinion agreed to by more than half of the members of a court. A majority opinion sets forth the decision of the court and an explanation of the rationale behind the court's decision. Not all cases have a majority opinion.

The role of the Courts of Appeal is not to give new trials, but to review the record in the trial court case to decide if a legal mistake was made and if that mistake affected the final outcome of the trial court case. The Courts of Appeal cannot review death penalty cases.

Six current justices were appointed by Democrats (Liu, Kruger, Groban, Jenkins, Guerrero and Evans) and one by Republicans (Corrigan). In certain cases, including Wednesday's ruling, Barrett has joined conservatives Chief Justice John Roberts and Justice Brett Kavanaugh in forming a bloc in the middle of the court, which has a 6-3 conservative majority. When that group votes with the three liberal justices, Thomas, Alito and Gorsuch can be sidelined.

Courts of Appeals

The 94 federal judicial districts are organized into 12 regional circuits, each of which has a court of appeals. The appellate court's task is to determine whether or not the law was applied correctly in the trial court. Appeals courts consist of three judges and do not use a jury.
